Need help in a Deposition?

Here are some tips to help make your outcome successful. Most people do not understand the impact a deposition can have on a trial, so you want to get it right. Typically these are things you should and should not do:

- Wear appropriate attire. Although depositions are not in front of a judge you should still dress appropriately.
- Take breaks. Depending on the trial the deposition can be rather be rather lengthy, so if you need a break take one.
- When asked a question take your time to think of what you are being asked and just answer it as direct as possible. Remember you are under oath and any lies can and will be used against you in court.
- Which leads us to our next point. Never Lie! Tell the truth. Any good lawyer asks questions he knows or has knowledge of the answer. If you lie, be prepared to pay the price.
- Give complete answers. When given a question to list things for example, give the complete list. Don't try to hide anything.
- Keep answers short and sweet whenever possible (yes, no, I do not know).

Things to avoid doing in a Deposition:

- Never freely give information that you are not asked about.
- Never inform the lawyer where he can locate information, that is the lawyers job.
- Never bicker with the attorney. The opposing attorney is not your friend but you must still show him or her respect.
- Never talk about testimony about the case unless you are in a private place no one else will over hear it. Otherwise you may be finding yourself talking about it after the break.
- Never give information that you do not know the real truth to. The old adage when you ASSUME you make an ASS out of U and ME is so true.
